This presentation is intended to provide practical information and guidance to risk managers as they deal with the resulting challenges. Among other things, it will address what steps risk managers can take to secure the best available coverage in the face of anticipated or potential ratings downgrades, market contractions, and pricing increases; how risk managers can most effectively facilitate the adjustment of claims and pursue the resolution of insurance coverage disputes as insurers try to conserve resources, both human and financial; and what risk managers can do to deal effectively with potentially increasing insurer insolvencies.

Who's First in Line? Indemnity Provisions and Contractual Liability Coverage in “Other Insurance” Clauses
Businesses regularly enter contracts in which one party agrees to provide the other with two types of protection against financial risk: (i) an agreement to indemnify the other party for any liability arising out of the first party's activities; and (ii) an agreement to procure a liability insurance policy (or policies) on which the other party is named as an additional insured. These indemnity and insurance-procurement obligations may be most common to construction contracts—in which a subcontractor typically provides protection to the general contractor—but they may also appear in all manner of business agreements, including joint ventures, mergers, or other corporate undertakings.
