David Killalea is a founding partner of Gilbert LLP whose diverse practice spans all aspects of insurance recovery and consumer rights litigation.
In the area of insurance recovery, David has represented companies large and small in securing insurance for their mass-tort and other liabilities in state and federal litigation, in alternative dispute resolution proceedings and in multi-party negotiations. In some of these representations, David has operated in the midst of several of the most hotly contested asbestos-related bankruptcy cases in the country. In such bankruptcies, David has successfully litigated complex disputes at the intersection of insurance and bankruptcy law and has secured many tens of millions of dollars in coverage for bankruptcy debtors. Examples of his representations include:
- Representation of a Fortune 100 pharmaceutical company in securing hundreds of millions of dollars in insurance coverage for asbestos-related and other products liability claims. On behalf of this client, litigated in several federal and state courts, and in arbitration proceedings
- Litigation involving insurance issues in bankruptcy cases, successfully enabling companies to transfer insurance assets to the benefit of creditors, over insurers’ objections, so that the debtors can emerge successfully from bankruptcy
- Advice to companies on legal strategy for managing assets in the context of mass-tort liabilities
In the area of consumer rights litigation, David is representing consumers in numerous state and federal courts concerning a variety of alleged unfair business practices. David and the firm’s co-counsel are seeking to right what they believe to be unfair business practices by, for instance, title insurers and a timeshare exchange company, that have cost consumers, collectively, tens of millions of dollars that they should never have been charged.
Prior to joining Gilbert LLP, David litigated a broad array of matters at Dickstein Shapiro, initially as an associate and then as a partner. Among other things, David litigated labor and employment cases, defended targets in grand jury investigations and defended individuals in criminal trials.
